These terms govern your use of the DAX Developers website. They explain who you are dealing with, what you may do on the site, how a project enquiry turns into real work, and where our responsibility begins and ends. Please read them before using the site or sending us a brief.

Acceptance of These Terms

These Terms of Service (the “Terms”) apply to your access to and use of daxdevelopers.com and every page, form and piece of content published on it (together, the “Site”). By browsing the Site, sending us a project brief, or otherwise using any part of it, you confirm that you have read and understood these Terms and agree to be bound by them, together with all laws and regulations that apply to your use of the Site.

If you are using the Site on behalf of a company or other organisation, you agree to these Terms on its behalf and confirm that you have the authority to do so. If you do not agree with any part of these Terms, you should stop using the Site.

Who These Terms Are With

DAX Developers (“DAX Developers”, “we”, “us” or “our”) is a trading name used by a group of independent software developers based in Pakistan who work together to design, build and ship software for clients. DAX Developers is not incorporated or registered as a company, partnership or other legal entity. The Site is owned and operated by Abdullah Arshad, and references to “we” in these Terms mean the operator and the developers working under the DAX Developers name.

We say this plainly because it matters when you decide to work with us. When a project goes ahead, the written agreement for that project identifies by name the individuals who are party to it and responsible for delivering it. You will always know exactly who you are contracting with before any work begins or any payment is made.

Permitted Use of the Site

We grant you a limited, personal, non-exclusive, non-transferable and revocable permission to access and use the Site for its intended purpose: learning about our services and our past work, and getting in touch with us about a potential project. You may view pages, share links to them, and print or save a copy of a page for your own reference.

This permission does not transfer ownership of anything on the Site to you, and it ends automatically if you breach these Terms. We may change, suspend or withdraw any part of the Site at any time without notice, and we are not liable to you if the Site or any part of it is unavailable for any period.

Prohibited Conduct

You agree not to use the Site in any way that is unlawful, fraudulent or harmful, or that interferes with anyone else’s use of it. In particular, you must not submit false or misleading information, impersonate another person, or send a project brief using a name, email address or phone number that does not belong to you or that you are not authorised to use. Our enquiry form sends a confirmation email to the address entered, and misusing it to send unwanted mail to a third party is a breach of these Terms.

You must not attempt to gain unauthorised access to the Site, its servers or any system connected to it; probe, scan or test its vulnerability without our written permission; introduce viruses or other malicious code; send automated, scripted or bulk submissions; or place an unreasonable load on our infrastructure. You also must not scrape, copy or systematically extract content from the Site, frame it within another website, or present our work as your own.

If we believe you have breached this section, we may block your access to the Site, disregard or delete your submissions, and report the activity to the relevant authorities where the law requires or allows it.

Intellectual Property

Unless stated otherwise, the Site and its contents, including its text, page designs, layouts, graphics, illustrations, source code and the selection and arrangement of all of these, are owned by us or used with the permission of their owners, and are protected by copyright and other intellectual property laws. The DAX Developers name and logo are ours, and nothing on the Site grants you any right to use them.

You may not copy, reproduce, modify, republish, distribute, sell or create derivative works from any part of the Site for commercial purposes without our prior written permission. Reasonable personal and non-commercial use, such as quoting a short passage with a link back to the source, is permitted.

Third-Party Names and Marks

The Site refers to technologies, frameworks, platforms and services made by other companies, and may display their names or logos to describe the tools we work with. Those names and logos are the trademarks of their respective owners. Their appearance on the Site is for identification only and does not mean that any of those companies endorses, sponsors or is affiliated with DAX Developers, unless we say so expressly.

Project Enquiries and Proposals

The Start a Project page lets you send us a brief describing what you want to build. When you send one, you confirm that the information is accurate to the best of your knowledge and that you are entitled to share it. Sending a brief does not create any contract between you and us, does not oblige either of us to go ahead, and does not reserve our time or capacity. We aim to reply within one business day, but we cannot guarantee a response time, and we may decline any enquiry for any reason.

Service descriptions, example budgets, typical timelines and any other figures on the Site are general information intended to help you plan. They are not a quotation, an offer capable of acceptance, or a promise of price, scope or delivery date. A project only begins once we have agreed its scope, price and terms with you in writing, typically as a proposal or statement of work signed by both sides. That agreement alone governs the work, including ownership of what we build, payment, confidentiality, warranties and liability. If it conflicts with these Terms, the project agreement prevails.

Please do not include passwords, access credentials, trade secrets or other sensitive information in a brief. If your project requires us to see confidential material before a proposal can be prepared, tell us, and we will sign a confidentiality agreement with you first.

Submissions, Feedback and Unsolicited Ideas

We welcome feedback about the Site and our services. Any comment, suggestion or idea you send us outside a signed agreement, whether through the enquiry form, by email or otherwise, is provided on a non-confidential basis, and you agree that we may use it to improve our Site and services without restriction or compensation to you.

This does not apply to the project brief itself. We use a brief only to respond to you and prepare a proposal, as described in our Privacy Policy, and we do not take the product idea in your brief and build it for ourselves or for anyone else. Because different clients sometimes come to us with similar ideas, however, receiving your brief does not stop us from working on similar projects independently or for other clients.

Portfolio, Case Studies and Figures

The Site shows examples of software our team has designed and built, including screenshots, product names, descriptions and links to live products. These are shown with the permission of the clients concerned. The products themselves, and all rights in them, belong to those clients. Their appearance on the Site does not mean that any client endorses us or these Terms, and nothing on the Site should be read as a statement made by or on behalf of a client.

Some of the work shown was delivered by members of our team as independent freelancers before they began working together under the DAX Developers name. Figures such as user numbers or content volumes describe those products at the time we worked on them, are drawn from the information available to us, and may have changed since. Past results are not a promise of the outcome of any future project.

No Professional Advice

Content on the Site, including service descriptions and answers to frequently asked questions, is general information about how we work. It is not technical, legal, financial, security or business advice tailored to your situation, and you should not rely on it as such. Advice specific to your project is given only in the course of a paid engagement under a written agreement.

Disclaimer of Warranties

The Site is provided on an “as is” and “as available” basis. While we take care in preparing what we publish, we do not guarantee that the Site or its content is accurate, complete or current, that it will be available without interruption, or that it is free from errors, viruses or other harmful components.

To the fullest extent permitted by law, we disclaim all warranties, representations and conditions relating to the Site, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, title and non-infringement. You are responsible for the devices and software you use to access the Site and for protecting them.

Limitation of Liability

To the fullest extent permitted by law, we will not be liable to you for any indirect, incidental, special, consequential or punitive loss or damage, or for any loss of profit, revenue, business, goodwill, data or opportunity, arising out of or in connection with your use of, or inability to use, the Site or your reliance on any content published on it. This applies whether the claim arises in contract, tort (including negligence), breach of statutory duty or otherwise, even if we were told that such loss was possible.

The Site is provided free of charge, and our total liability to you for any claim relating to it is limited accordingly. Nothing in these Terms excludes or limits any liability that cannot be excluded or limited under applicable law, such as liability for fraud. Liability for project work is dealt with separately in the written agreement for that project.

Indemnification

You agree to indemnify and hold harmless DAX Developers, its operator and the developers working under its name against any claims, losses, liabilities, damages, costs and expenses (including reasonable legal fees) arising from your breach of these Terms, your misuse of the Site, or any information you submit through it that infringes the rights of a third party or breaks the law.

Third-Party Sites and Links

The Site contains links to websites and services operated by others, including live client products, social media platforms and the tools we use. We provide these links for convenience only. We do not control those sites, and we are not responsible for their content, availability, security or privacy practices. A link does not mean we endorse the site or anything on it, and your use of any third-party site is governed by that site’s own terms.

Privacy

Our Privacy Policy explains what personal information we collect through the Site, why we collect it, who processes it on our behalf, how long we keep it and the rights you have over it. The Site sets no cookies and uses no advertising trackers, and its only analytics is anonymous, cookieless visit counting. By using the Site, you acknowledge that your information will be handled as that policy describes.

Governing Law and Jurisdiction

These Terms, and any dispute or claim arising out of or in connection with them or with your use of the Site, are governed by the laws of the Islamic Republic of Pakistan. Subject to the following section, the courts of Pakistan have exclusive jurisdiction to settle any such dispute.

If you use the Site as a consumer, nothing in this section deprives you of the protection of any mandatory law of the country in which you live, or of your right to bring proceedings in the courts of that country where the law gives you that right.

Dispute Resolution

If you have a concern about the Site or these Terms, we would much rather hear about it directly. Before starting any formal proceedings, please email us at contact@daxdevelopers.com with a description of the issue and what you would like us to do. We will acknowledge your message and work with you in good faith to resolve it, and both sides agree to allow at least 30 days for that process before taking the matter further. Disputes about a project are handled under the dispute terms of that project’s agreement.

Changes to These Terms

We may revise these Terms from time to time, for example to reflect changes to the Site, to how we work, or to the law. When we do, we will publish the updated version on this page and change the “Last updated” date at the top. Changes take effect when they are published and apply to your use of the Site from then on. They do not affect any signed project agreement. Please check this page from time to time. If you continue to use the Site after a change, you accept the revised Terms.

Severability

If any provision of these Terms is found by a court or other competent authority to be invalid, unlawful or unenforceable, that provision will be applied to the maximum extent permitted, or removed if necessary, and the remaining provisions will continue in full force and effect. Our failure or delay in enforcing any provision is not a waiver of our right to enforce it later.

Entire Agreement

These Terms, together with our Privacy Policy, make up the entire agreement between you and us about your use of the Site, and replace any earlier understanding about it. They do not replace or vary any written agreement for a project, which remains the complete statement of the terms of that engagement. You may not transfer your rights under these Terms to anyone else. We may transfer ours, for example if the business behind DAX Developers is restructured or registered as a company.
